Property Division Attorney in Daytona Beach

What constitutes equitable distribution?

A major part of any divorce proceedings is the issue of property division.  Florida follows the system of "equitable distribution" of all marital assets and liabilities.  This does not mean, however, that a 50/50 split is necessarily considered the most equitable.  While a 50/50 division is used as the starting point, the court can consider many factors in making a final determination regarding property division.  Some of those factors include:

  • The duration of the marriage
  • The economic circumstances of each party
  • The contributions each spouse made to the marriage, including those concerning the care and education of the children as well as services as a homemaker
  • Any interruption of the education or career of either party for purposes of contributing to or supporting the marriage
  • Ownership and/or use of the family home as it relates to the raising of any minor children involved
  • The wishes of each party regarding retaining sole title to any particular asset or concern
  • Any intentional wasting, depleting or destroying of martial assets within two years prior to the divorce filing or at any time thereafter
